These Terms describe the rules for using Service Nitro’s website and requesting its marketing and appointment services. A signed proposal, order, or service agreement may add to or replace terms for a specific engagement.

01Agreement

These Terms of Service (“Terms”) govern your access to and use of the Service Nitro website, landing pages, forms, appointment calendar, creative library, and related services (together, the “Services”). By using the Services, submitting information, scheduling a call, or accepting a proposal that references these Terms, you agree to them.

If you use the Services for a company, you represent that you have authority to bind that company. If you do not agree, do not use the Services.

02Services and the 30-day trial

Service Nitro provides growth marketing services for home-service companies. Services may include market and competitor research, advertising strategy and management, landing pages, conversion tracking, lead routing, follow-up recommendations, creative development, reporting, and appointment support.

When offered and approved, the 30-day trial waives Service Nitro’s agency management fee for the first 30 days. The trial is qualification-based, may be limited by market, and may be declined or ended if the fit, information, capacity, responsiveness, or conduct is not appropriate.

Advertising spend is not included. You are responsible for approved advertising spend and for any third-party costs, software, media, production, or other charges identified before they are incurred. A fee waiver does not mean that every cost associated with a campaign is free.

Continuing after the trial requires agreement on the scope, fees, budget, and other terms for ongoing work. Unless a signed agreement says otherwise, either party may decide not to continue after the trial.

03Your responsibilities

You agree to provide accurate, current information and to promptly review and approve materials, campaigns, landing pages, claims, offers, budgets, and other decisions that require your input.

You are responsible for maintaining the licenses, insurance, registrations, permits, pricing, service capacity, staff, customer experience, and legal compliance required for your business. You are also responsible for responding to inquiries promptly and for honoring commitments you make to your customers.

You must not provide credentials, personal information, customer lists, or other materials unless you have the right to share them and have provided any notices or obtained any consents required by law.

04Leads, accounts, and outcomes

Leads, inquiries, appointment details, and campaign data generated for your business may be routed through third-party advertising, scheduling, CRM, analytics, or communication systems. Access, ownership, export, and retention of that information may also be governed by those systems and by a signed agreement.

Where we create or manage advertising accounts or assets for you, the parties will determine in writing who owns the account, who controls billing, and how access is handled. You remain responsible for your account credentials and for approving advertising budgets and destination content.

Marketing results vary by market, offer, budget, competition, seasonality, response speed, sales process, customer demand, platform decisions, and other factors outside our control. We do not promise a specific number of leads, calls, appointments, jobs, revenue, return on ad spend, ranking, or profit.

05Third-party services

The Services may connect with or depend on third-party platforms, including advertising networks, analytics tools, hosting providers, customer relationship systems, appointment calendars, email or text providers, payment providers, and other software. Those platforms have their own terms, policies, fees, outages, approval processes, and data practices.

We do not control third-party platforms and are not responsible for their availability, changes, suspension, account decisions, security incidents, or terms. You authorize us to use the third-party services needed for the agreed scope, subject to your approvals and any applicable agreement.

06Communications

When you provide an email address or telephone number, we may contact you about your request, appointment, account, trial, or Services. Appointment confirmations and reminders may be sent by Service Nitro or a scheduling provider.

Marketing emails include an unsubscribe method. Where marketing text messages are separately permitted and consented to, you may reply STOP to opt out and HELP for assistance. Message and data rates may apply. Opting out of marketing does not stop service or appointment communications that are necessary for a transaction.

07Content and acceptable use

You may use the Services only for lawful business purposes. You may not interfere with the Services, probe or bypass security, scrape or harvest information without permission, upload malicious code, impersonate another person, infringe rights, submit false information, or use the Services to send unlawful or deceptive advertising.

You are responsible for claims, testimonials, images, logos, trademarks, reviews, pricing, guarantees, certifications, and other content you provide or approve. You represent that you have the rights and permissions needed for us to use that content for the agreed Services.

08Intellectual property

The Service Nitro name, logos, website, templates, systems, copy, designs, processes, reports, software, and other materials we provide are owned by Service Nitro or its licensors unless a written agreement says otherwise.

Subject to payment of amounts due and the agreed scope, we grant you a limited, non-exclusive, non-transferable license to use final deliverables created specifically for you. We may retain and reuse general skills, ideas, know-how, templates, methods, anonymized performance insights, and pre-existing materials that do not identify you or disclose confidential information.

You grant Service Nitro permission to use materials you provide only as needed to provide, promote, secure, and improve the Services, subject to the confidentiality and privacy obligations that apply.

09Disclaimers

The Services are provided on an “as available” basis. To the maximum extent permitted by law, Service Nitro disclaims implied warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, error-free operation, and any expectation of a particular marketing result.

Service Nitro is not a law firm, accounting firm, financial adviser, insurance adviser, employment adviser, or regulatory compliance adviser. You are responsible for obtaining professional advice when needed and for ensuring that your advertising, offers, data practices, and business operations comply with applicable law.

10Liability and indemnity

To the maximum extent permitted by law, Service Nitro and its owners, officers, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, or business interruption arising from or related to the Services or these Terms.

To the maximum extent permitted by law, the total aggregate liability of Service Nitro for claims related to the Services will not exceed the fees you paid to Service Nitro for the three months before the event giving rise to the claim, or one hundred dollars if no fees were paid.

You agree to defend and indemnify Service Nitro and its affiliates, personnel, and providers from claims, losses, liabilities, costs, and expenses arising from your content, business, products, services, advertising claims, customer relationships, breach of these Terms, or violation of law or another person’s rights.

11Termination and changes

We may suspend or terminate access to the Services, a trial, or an account if we reasonably believe there is a security risk, legal issue, abuse, nonpayment, breach of these Terms, or a material breakdown in the working relationship. You may stop using the Services at any time, subject to amounts owed and any signed agreement.

We may update these Terms as the Services or law changes. Updated Terms will be posted on this page with a new effective date. Continued use after an update means you accept the updated Terms, except where applicable law requires additional consent.

Sections that by their nature should survive termination, including intellectual property, disclaimers, liability, indemnity, dispute provisions, and payment obligations, will survive.

12Governing law and contact

These Terms are governed by the laws applicable to Service Nitro’s principal place of business, without regard to conflict-of-law rules, unless a signed service agreement states otherwise. Any dispute should first be raised with us so the parties have a reasonable opportunity to resolve it directly.
